the bas ofthe creek but there was no sign of the man. this all began after midnight when ross police made a dui stop on the man's car near sir francis drake and college. but during the field sobriety test, this man took off running from officers. officers watched him go in the creek and eventually lost sight of him. >> they followed for about 100 yards trying to encourage the person to come out of the swift water. he swam away from the officers. the officers followed him as far as they could until they couldn't anymore. >> reporter: now, the ross police chief said he isn't going to release the name of the missing man at this point but police are very concerned about his well being since the water is cold and the current, especially in the air area where he went in, is -- in the area where he went in, is swift. it's possible a dive team could be called in to search for him. but we understand the search- and-rescue team will pick up the search at 7:00, the chief said. we have not seen them yet. we'll monitor the situation. we're live in green brain -- greenbrae this morning, alex savidge, k

1238 and the town of ross. they pulled over a suspected drunken driver. when they were giving the sobriety test to the suspect he took off 01 feet and just over a fence. he it and jumped into this creek. they were able to have visual contact with their flashlights but they try to encourage him to get out of the water and that of merely they lost contact with him. they called other agencies to come out to help the mob.them out. >> they searched until about 430 this morning looking for any signs of the suspect. they could not find anything so that suspended the search. if they come back at daybreak to continue the search. so far they do not have any informational. this is where the command post was an obviously as this case and developing we will pass on any new information that we did. right now, we are waiting for search and rescue to come out here and start searching the creek again. >> authorities say they responded to a call of shots fired in the 700 block of market street around 830 last night. when they arrived, officers on an adult males suffer from a gunshot wound. that

on cnbc. i'm andrew ross sorkin along with joe kernen. becky quick is off today. our best host this hour, alexander ladenthal. we have a lot to cover with her this morning. here we are, christmas eve. it's a shortened trading session for christmas eve. u.s. equity markets will close at 1:00 p.m. eastern time. bond currency and commodity trading they're going to end early. in japan, indonesia, the philippines, they were all closed in europe. only the uk, french, dutch and spanish stock markets are open and they're going to be closing early. there are now only five trading sessions left in 2012. get your act together. stocks and bonds, solid gains so far this year. the dow has advanced 8% in total. the s&p 500 up almost 14%. the nasdaq has jumped 16%. it's been a good year. the end of the year also means we are just days away from the fiscal cliff, however, and that's the bad news. and looming tax hikes, spending cuts, all of that. both sides warning a very big deal becoming a bit more unlikely. >> and my one bit of advice to speaker boehner is this. you cannot pass a bill with just republ

the north bay, police in ross and search and rescue teams have put search for a dui suspect on hold after he jumped into a frigid creek this morning he bolted from his car midnight officers were chasing him on along a trail near the college of marin an officer saw him jump into the creek. officers followed along until a swift water rescue team from the southern marin fire department arrived, the suspect either got away or drowned. they will resume the search at sunrise. >>> on the peninsula, emergency officials keeping a close eye on the levees that tfplt m is live in palo alto. >> reporter: good news and not so good news. good news, the creek is really gone down quite a bit we do here a little before 4:30, we've been doing reports all morning. it is going down dramatically. but, the problem is not over. last night the creek was overflowing and causing hundreds to be evacuated in the garden subdivision in east palo alto. again, no rain now, hasn't rained for many hours. creek going down. but, there is concern that the levee 600 feet worth of it, may have been damaged as a result of this stro

. for example my classmate gary ross kept himself in the closet and tell until "don't ask don't tell" was lifted just when he continued putting himself in harm's way and serving our country. we just heard about my classmate, matt freeman. i learned about matt's death on facebook which is obviously not the ideal ways to learn that one of your friends has been killed but it did allow me to go right to stage and see what people were saying about him at the time which was incredibly, incredibly cathartic. i remember looking at what he'd written before he was killed in the ops -- obviously put a post up that someone interpreted as disagreeing with president obama's policies and the start of one of these arguments you see on facebook all the time enselman says you said this and i think this and you go back and forth and you say please just shut up. matt was incredibly inspiring. he said don't fight on my page. i disagree with some political decisions but he is my commander in chief and i support him and all military systems. to my knowledge that was the last post my friend matt wrote on facebook. in
